The provider told people about their rights around consent and respected these when delivering person-centred care and treatment.

We checked whether the service was working within the principles of the Mental Capacity Act 2005 (MCA). Staff sought people's consent and supported them in the decision-making process. Family members’ comments included, “Yes, [staff] always ask what works for [my relative] and we talk it through. They don’t just assume.” A staff member told us, “If clients don’t have the mental capacity to decide, they get help. Everyone is deemed to have the capacity if this is not proven otherwise. Even if they make the wrong choices.”

Records showed that mental capacity assessments were completed by the service to support people in the decision-making process. However, some of these assessments needed to be more decision-specific to ensure people’s capacity was accurately assessed. The management team told us this would be addressed immediately.
