Accommodation for persons who require nursing or personal care

Condition of this registration relating to carrying out this regulated activity
A. The registered provider must not admit any service user to the location at Restgarth Care Home without the prior written agreement of the Care Quality Commission. This includes any respite care packages, and existing service users who are discharged from hospital. The term ‘admit’ includes readmission of any service user.
B. The registered provider must ensure there is effective oversight of the service by a skilled and competent person. The registered provider must send a weekly report to the Commission every Tuesday starting 7 October 2025 with details of management arrangements for the week.
C. The registered provider must complete an audit and review of all service users’ care needs, and a copy of this review must be sent to the Commission by 8 October 2025, and each second Tuesday of every month thereafter, identifying any shortfalls and the actions taken in response. The review must:
a. Identify immediate risks associated with service users’ personal care needs and inform an urgent review and updating of care plans and risk assessments. These need to include, but not be limited to, risks in relation to continence care, skin integrity, nutrition and hydration and capacity.
b. Ensure escalation to appropriate medical professionals takes place as necessary, which should include utilising specialist advice from a multidisciplinary professional team to assess and mitigate the risks relating to skin damage and outcomes recorded.
c. Identify where mental capacity assessments and best interest decision making records are required. Apply for any necessary DoLS authorisations and inform the local DoLS team of any changes in restrictions to people’s liberty.
D. The registered provider must send a report to the Commission with details of planned staff rotas for the following four weeks. An initial report must be sent to the Commission by 8 October 2025, and each second Tuesday of every month thereafter.
a. This should include names and designations of each staff member on each shift, including analysis of any gaps in staff members training and experience, their normal place of work and whether they are employed or agency staff.
b. Staffing levels achieved in the preceding four weeks. On any occasion when planned staffing levels were not met, including managers hours, provide an explanation as to why this occurred, what impact it had on service users and what action was taken to reduce the risk of reoccurrence.
E. The registered provider must ensure they have reviewed the training needs and competency of all staff, including any staff not directly employed by Restgarth Care Home; e.g staff from The Beeches and agency staff. This should include but not be limited to management of medication, moving and handling, continence care, person-centred care and the Mental Capacity Act. You must demonstrate what actions you have taken to ensure staff have the correct skills and competency required. You must supply evidence of this to the Commission by 4pm on 7 October 2025.
F. The registered provider must send a report to the Commission on the second Tuesday of each month with details of completed quality monitoring audits and checks including evidence of compliance with the conditions imposed. This report must include an action plan with timescales. The report must include areas covered, shortfalls identified at the service, your findings, and any responsive actions, clearly identifying who is responsible and the timescales for this. This report must include actions taken as a result of the reviews and audits to ensure any risks identified have been assessed and mitigated appropriately.
Terms of this registration relating to carrying out this regulated activity
The registered provider must not provide nursing care under accommodation for persons who require nursing or personal care at Restgarth Care Home.
The registered provider must only accommodate a maximum of 32 service users at Restgarth Care Home.
The registered provider must not provide Accommodation for persons who require nursing or personal care in a specialist service to people whose presenting need for care or support is as a direct result of the person’s learning disability and or autism at or from Restgarth Care Home.
