Condition of this registration relating to carrying out this regulated activity
The registered provider must not provide personal care to any new service
users, without the prior written agreement of the Care Quality Commission. This
includes service users who have previously received care from Falcon Care Ltd,
service users requiring emergency provision, and when service users return
from in-patient hospital admissions.
The registered provider must ensure individual risks in relation to Service Users
A, B, C, D E & F are reviewed, assessed and mitigated. Where staff guidance
is put in place, this mitigation includes how this information will be shared with
relevant staff. Evidence of this review and mitigation of the above risks must be
provided to the Commission, via email, within 4 working days.
Within 1 day of this notice, the provider must identify which staff have not yet
had a disclosure and barring check (DBS) request requested by Falcon Care
Agency Ltd. The provider must then make disclosure and barring check
requests for these staff members within 2 days of this notice. A list of all staff
names, which have been included in this DBS request, must be sent to the
Commission within 24 hours of being requested from the DBS service
Within 1 day of this notice, the provider must gather the employment history of
all staff working at Falcon Care Ltd. The provider must then identify which of
these staff have had suitable references gathered in line with the provider’s
policy. Where references have not been gathered, the provider must request
these references within 2 days of this notice. A list of all staff names, which have
been included in this reference request, must be sent to the Commission within
24 hours of references being requested.
The provider must complete an action plan on how they will ensure service
users are safely supported while awaiting the DBS and reference outcomes for
these staff. This action plan must be sent to the Commission within 3 days of
this notice.
Within 1 day of this notice, the provider must identify which service users require
support from staff with: suctioning, restraint, moving and handling, medicine
administration, swallowing needs, and falls. The provider must also identify the
number of staff and which staff members support these named service users.
The registered provider must provide evidence by 15 March 2023 in respect of
Falcon Care Agency Ltd that:
a. All staff have received training in restraint, choking, dysphagia and first aid
b. All staff have received training in safeguarding referrals for vulnerable
service users at the required level;
c. If this training cannot be completed by 15 March 2023 the provider must
evidence how they will ensure skilled and safe care is provided to service
users while this training is arranged. This evidence must be emailed to the
Commission by the 15 March 2023.
The registered provider must provide the Care Quality Commission with written
documentation within 5 days setting out how they will ensure that there is an
effective system to identify and assess any potential safeguarding issues and
the management of vulnerable children and adults. This must include the
maintenance of a register and a protocol for escalating concerns in line with
local safeguarding arrangements. This documentation must include what action
will be taken, what appendices (documentation) will ensure
oversight/improvement, who will be responsible for taking this action and who
will be responsible for reviewing the effectiveness of the action plan.
An updated action plan must then be sent to the commission on the first
Tuesday of the month. This updated action plan must include what action the
management team have taken since this action plan has been in place.
