During an inspection looking at part of the service

We undertook a follow up focused inspection of Mr G Lai & Associates - Willesden on 13 June 2023. This inspection was carried out to review in detail the actions taken by the registered provider to improve the quality of care and to confirm that the practice was now meeting legal requirements.

The inspection was led by a CQC inspector who was supported by a specialist dental adviser.

We had previously undertaken a comprehensive inspection of Mr G Lai & Associates - Willesden on 22 November 2022 under Section 60 of the Health and Social Care Act 2008 as part of our regulatory functions. We found the registered provider was not providing safe and well-led care and was in breach of regulations 12 and 17 of the Health and Social Care Act 2008 (Regulated Activities) Regulations 2014.

We undertook an unannounced focused follow up inspection on 5 May 2023 and found that the registered provider was in breach of regulation 12, 17 and 18 and was not providing safe and well-led care. Due to the nature of concerns identified during the follow up inspection on 5 May 2023, we served a Notice of Proposal to the provider, proposing to vary a condition on their registration which specifies the locations they are authorised to carry on the regulated activities from, so they would no longer be authorised to carry on the regulated activities from the location Mr G Lai & Associates – Willesden.

When one or more of the five questions are not met we require the service to make improvements and send us an action plan We then inspect again after a reasonable interval, focusing on the areas where improvement was required.

During the inspection on 13 June 2023, we found that the risks identified on 5 May 2023 had been sufficiently mitigated. Subsequently, we have withdrawn our notice of proposal to vary a condition on the provider`s registration which specifies the locations they are authorised to carry on the regulated activities from.

We found this practice was providing safe care in accordance with the relevant regulations.

The provider had made improvements in relation to the regulatory breaches we found at our inspection on 5 May 2023.

Mr G Lai & Associates - Willesden is in the London Borough of Brent and provides NHS and private dental care and treatment for adults and children.

The practice is not fully accessible to people who use wheelchairs and those with pushchairs. The practice communicates this to new patients before booking, and signpost people with mobility issues to nearby practices. Car parking spaces are available near the practice.

The dental team includes the principal dentist, an associate dentist, a foundation dentist, a qualified dental nurse and a trainee dental nurse. The practice has 3 treatment rooms.

During the inspection we spoke with the principal dentist, the associate dentist and 2 dental nurses. We looked at practice policies and procedures and other records about how the service is managed.

The practice is open:

Monday to Friday 9.30am to 6pm.

There were areas where the provider could make improvements. They should:

  • Take action to ensure that all clinical staff have adequate immunity for vaccine preventable infectious diseases.

  • Take action to ensure the regulated activities at Mr G Lai & Associates - Willesden are managed by an individual who is registered as a manager.

  • Ensure persons employed in the provision of the regulated activities receive the appropriate support, training, professional development, supervision and appraisal necessary to enable them to carry out their duties.
  • Establish effective systems and processes to ensure good governance in accordance with the fundamental standards of care.

During a routine inspection

We carried out this announced comprehensive inspection on 22 November 2022 under section 60 of the Health and Social Care Act 2008 as part of our regulatory functions. We planned the inspection to check whether the registered practice was meeting the legal requirements in the Health and Social Care Act 2008 and associated regulations. The inspection was led by a Care Quality Commission (CQC) inspector who was supported by a specialist dental advisor.

To get to the heart of patients’ experiences of care and treatment, we always ask the following 5 questions:

• Is it safe?

• Is it effective?

• Is it caring?

• Is it responsive to people’s needs?

• Is it well-led?

These questions form the framework for the areas we look at during the inspection.

Our findings were:

  • Staff knew how to deal with medical emergencies. Appropriate medicines and life-saving equipment were available.
  • Patients were treated with dignity and respect and staff took care to protect their privacy and personal information.
  • Staff provided preventive care and supported patients to ensure better oral health.
  • The appointment system took account of patients’ needs.
  • Staff felt involved and supported and worked as a team.
  • Complaints were dealt with positively and efficiently.
  • The dental clinic had information governance arrangements.
  • The clinical staff generally provided patients’ care and treatment in line with current guidelines. Improvements were needed to their knowledge and understanding of the National of Institute of Excellence (NICE) guidelines and consent.
  • There were some systems in place to support continuous improvement. However, there was ineffective leadership and a lack of oversight for the day-to-day management of the service.
  • The dental clinic did not appear visibly clean and well-maintained.
  • The practice did not have infection control procedures which reflected published guidance.
  • There were ineffective processes in place to prevent abuse of vulnerable adults and children.
  • Risks to staff and patients from undertaking of regulated activities had not been suitably identified and mitigated.
  • The provider did not have suitable staff recruitment procedures to comply with current legislation.
  • Improvements were needed to the systems and processes for seeking and learning from patient feedback.

There were areas where the provider could make improvements. They should:

  • Take action to ensure the clinicians carry out patient assessments and ensure they are in compliance with current legislation and take into account relevant nationally recognised evidence-based guidance.
  • Improve and develop staff awareness of the requirements of the Mental Capacity Act 2005 and ensure all staff are aware of their responsibilities under the Act as it relates to their role.
  • Implement processes and systems for seeking and learning from patient feedback with a view to monitoring and improving the quality of the service.

During a routine inspection

We were not able to speak to patients using the service because there were no patients available during our visit. We gathered evidence of patients' experiences of the service by reviewing their comments and other relevant sources, including feedback from patient surveys and audits.

Overall, we found patients were satisfied with the quality of the service they received. Their comments were largely positive. Patients were involved in their care and there was evidence from their treatment records that treatment was planned and delivered in line with their individual needs.

The dentists and staff were aware of different forms of abuse and knew who they needed to contact in instances where they needed to make a referral.
