Background to this inspection

We carried out this inspection under Section 60 of the Health and Social Care Act 2008 as part of our regulatory functions. This inspection was planned to check whether the provider is meeting the legal requirements and regulations associated with the Health and Social Care Act 2008, to look at the overall quality of the service, and to provide a rating for the service under the Care Act 2014.

This focused unannounced inspection on 19 April 2017 was carried out to check that improvements to meet legal requirements planned by the provider after our 22 November 2016 inspection had been made. One inspector inspected the service against one of the five key questions we ask about services: is the service safe? This was because the service was not meeting some legal requirements.

Prior to this inspection we reviewed information we have about the service including notifications. A notification is a report about important events which the service is required to send us by law.

As part of this inspection we observed medicines being given to one person. We spoke with the registered manager, the nominated individual and a nurse. We looked at the care records for two people and medicines records. We looked at recruitment records for two new members of staff. Recruitment information was provided after the inspection which had not been available during our visit.

This was an unannounced inspection which took place on the 19 April 2017. Lypiatt Lodge provides accommodation, nursing and personal care for up to 31 older people. At the time of our inspection there were 18 people living there of whom the majority were living with dementia.

There was a registered manager in post. A registered manager is a person who has registered with the Care Quality Commission to manage the service. Like registered providers, they are ‘registered persons’. Registered persons have legal responsibility for meeting the requirements in the Health and Social Care Act 2008 and associated Regulations about how the service is run.

We undertook this focused inspection on 19 April 2017 to check that they had followed their plan and to confirm that they now met legal requirements in relation to breaches of Regulation 12 and 19. This report only covers our findings in relation to these issues. At the unannounced comprehensive inspection of this service on 22 November 2016 breaches of legal requirements were found. After this comprehensive inspection, we asked the provider to take action to make improvements to the administration and management of medicines and this action had been completed. We also asked the provider to take action to make improvements to the recruitment and selection processes for new staff. Although some improvements had been made these had not been sustained.

We have made a recommendation about the management of recruitment and selection records.
