During an inspection in response to concerns

At our inspection on 31 May 2013 we followed up on enforcement action we took following our previous inspection in relation to the care and welfare of people, staff recruitment and staff supervision. We also responded to some concerns we received from a whistle-blower.

We were unable to speak to most people who used the service despite making attempts to speak to them. One person we spoke to whose first language was not english indicated they were happy with the service. One person's relative we spoke with told us their carer was "alright" and told us the staff member provided the care and support they needed them to. We also spoke to a social worker who oversaw the care two people received. The social worker told us that the feedback they had received about the service had been "fairly positive" and that people were "fairly happy" with the care they received.

We found that people's care needs were assessed, but sometimes people's care plans lacked detail which meant there was a risk of unsafe or inappropriate care being delivered. The provider carried out risk assessments but not all risks had been identified or assessed and risk assessments did not always provide information on how risks could be prevented or reduced. The provider had not ensured that staff were always adequately checked before they began work and we found staff were insufficiently inducted, trained and supervised.

During an inspection looking at part of the service

Our inspection at Winnex Care Limited on 21 November 2012 followed up issues which were found at our inspection on 22 May 2012 including reviews of risk assessments and delivery of people's planned care, recruitment procedures and staff training and support. At our inspection on 21 November 2012 we found the provider had not implemented the required improvements.

We were able to speak to one person's family who told us they were happy with the service that had been provided. They told us they felt the staff were good and they carried out the tasks they were meant to. We were unable to contact the other two people the provider had recently delivered a service to.

We found the provider had assessed people's needs before delivering a service to them, however they had not always considered the risks to people and their staff. The provider had not followed appropriate recruitment procedures which meant staff began delivering a service to people without being checked to see if they were appropriate to do so. Staff had not been adequately trained before delivering a service to people and staff were inadequately supported to carry out their roles.

During a routine inspection

We made attempts to speak with the two people who used the service at the time of our visit, but both declined to be interviewed. We spoke with a relative of a service user whose care package provided by Winnex Care had ended in October 2011. They told us they had experienced some problems with the agency relating to the choice and reliability of care staff, and communication from the agency.

We were able to gauge some feedback from people by looking at records of conversations between office staff and the people who used the service, as well as some information provided by carers in their daily care notes.
