While there had been some improvements, the provider did not always follow the principles of the Mental Capacity Act. This meant some people were restricted without the right legal authority. For example, we saw people’s movements limited by postural chairs and lap straps, and in some cases, these restrictions were not properly authorised.

We found mental capacity assessments were not always fully completed and often lacked enough detail to show compliance with the Mental Capacity Act.
