Supreme Court judgement on deprivation of liberty

The Supreme Court has handed down a judgment which is of the greatest importance to health and social care providers. The judgment has widened and clarified the definition of deprivation of liberty.

Health and social care providers, and CQC inspectors, must understand how to decide whether arrangements made for the care and/or treatment of an individual who might lack mental capacity amount to a deprivation of liberty.
