During an inspection looking at part of the service

We did not speak to people using the service at this inspection because the visit was made to check that improvements to the record keeping at this service had been carried out. At our inspection of 14 February 2013 we found that people were not protected from the risks of unsafe or inappropriate care because records of staff supervision, staff appraisal and spot checks of care at people's homes were not available.

At this inspection we found that records of spot checks were not always being recorded. This meant that people continued not to be protected from the risks of unsafe or inappropriate care. There was no evidence that care staff were monitored to be able to care effectively for people. We also found that the staff supervision was not being carried out, that staff recruitment processes were inadequate and that staff were not being supported fully. This meant that people receiving the service were at risk from unsafe or inappropriate care because staff were not being adequately recruited, supervised and supported.

We are considering what further regulatory action is needed to ensure that the provider becomes compliant with the regulations.

During a routine inspection

People who use the service we contacted had palliative care needs and were not able to speak to us. We spoke with three of their relatives instead. They informed us that they were satisfied with the care provided by care staff and people had been treated with respect and dignity. Their views can be summarised by the following comment, 'I am happy with the carers provided. They are excellent. They treat my relative with respect and do their jobs very well. I would recommend them to others.'

Care staff we spoke with were aware of the importance of treating people with respect and dignity regardless of their diverse backgrounds. The care provided had been assessed and care plans prepared. Risk assessments were in place. Relatives of people said they had been consulted and involved in their relatives' care plans.

The agency had suitable arrangements for ensuring that people were safeguarded and protected from abuse. Staff had been provided with training on safeguarding people and other appropriate training to enable them to perform their duties. Supervision and support were available to them.

Some essential records relating to staff support were not available. These records were needed to provide evidence that care staff were provided with support and supervision.
