Controlled drug designated body exemption appeal process

  1. You have one month (31 days) to appeal against the decision to refuse your application for an exemption or renewal of an exemption or for rescinding your exemption starting from the date of the letter of decision.
  2. We may accept an appeal received outside the time limit for making the appeal if there is a reasonable explanation as to why the appeal was late. You will be required to set out the reasons as to why your appeal was late and demonstrate that you appealed as soon as you could. If we decide not to accept the late appeal, we will inform you of our decision by email.
  3. You are required to provide your appeal in writing (using the appeal form which can be downloaded below). The completed form must be submitted electronically to enquiries@cqc.org.uk and can include any additional information that supports your appeal.
  4. In considering your appeal, we are required to consider the benefits versus difficulties of appointing an accountable officer as set out in regulation 3 of The Controlled Drugs (Supervision and Management of Use) Regulations 2013. We will take into account the size of the organisation, the usual level of relevant activities at or provided from the hospital, and any difficulties there may be in identifying a suitable individual to act as an accountable officer, taking into account the size of the business being carried on at or from the hospital and any possibility of a joint appointment or nomination by that hospital together with other hospitals.
  5. The appeal will usually be completed within one month (31 days).  When we have considered your appeal we will email you to inform you of the decision.
