Meeting this standard

We checked that people who use this service

  • Where they are able, give valid consent to the examination, care, treatment and support they receive.
  • Understand and know how to change any decisions about examination, care, treatment and support that has been previously agreed.
  • Can be confident that their human rights are respected and taken into account.

How this check was done

We looked at the personal care or treatment records of people who use the service, carried out a visit on 14 January 2013, talked with people who use the service and talked with carers and / or family members. We talked with staff.

Our judgement

Before people received any care or treatment they were asked for their consent and the provider acted in accordance with their wishes.

Reasons for our judgement

We looked at the records of three people using the service. We saw that the care plans had been agreed with and signed by the person using the service or their representative. We noted that changes to the care plans had also been signed by the person or their representative.

We spoke with four people who used the service. They told us they had consented to the care being provided.

We looked at whether staff understood the Mental Capacity Act and how the Act might impact on their practice (The Mental Capacity Act provides a framework to empower and protect people who may lack capacity to make some decisions for themselves).

We were informed by the manager that 19 of the 40 staff had completed a one day training event on the Mental Capacity Act. The remaining staff were also going to receive training to understand the Act. The registered manager and two care co-ordinators who were responsible for undertaking the initial needs assessments of people using the service had undertaken the training and understood how to determine the capacity of people to make decisions for themselves.
