Leicestercare home has failed to protect people’s safety and welfare says regulator

Marston Court Care Home is not meeting the essential standards.
The Care Quality Commission (CQC) has told the owners of Marston Court Care Home they will face further enforcement action unless they make improvements to standards of care, quality and safety.
The warning follows an unannounced inspection in January to check whether the care home had made improvements required after a previous inspection.
Inspectors found the provider, Marston Court Limited, was failing to meet all four of the essential standards of care and safety they looked at.
Among these were the Government regulation covering the care and welfare of people, which the provider was still failing to meet. As a result, CQC has issued a warning demanding that improvements are made in relation to this regulation.
What inspectors found:
Care and welfare of people who use services
Inspectors found, people did not always receive safe, effective care and support which met their needs due to changes in the service. This related to changes in the accommodation and people being moved within the service. Inspectors could find no evidence of people having been consulted in relation to this change of location when they carried out their inspection. There had also been a lack of preparation, training and support for staff with regard to this.
The provider has a deadline for improvement of March 27 in relation to the warning notice issued in respect of this regulation.
Respecting and involving people who use the services
CQC staff observed staff being disrespectful towards people in their care and found that people’s dignity was not always respected. Staff were seen talking about people and their needs in communal areas when this could have been done privately elsewhere on the site.
Assessing and monitoring the quality of service provision
Inspectors could find no evidence that a representative of the provider had visited the service regularly to assess of monitor the care being received by people. There were also no infection control audits and the provider was found to have failed to take account of the impact their decisions may have on people using the service.
Cleanliness and infection control
CQC issued a warning notice requiring improvement by February 27. A subsequent inspection has now found that the provider had made improvements in this area.
Andrea Gordon, Deputy Director of Operation (regions) for CQC, said: “The continuing failings at Marston Court Care Home are a real concern. These improvements must be made or we will consider taking further action.
“The provider needs to ensure at all times that people are treated with respect, hygiene standards are maintained, people are consulted about changes to their care and this is documented and that the provider monitors the service being provided.
“Our inspectors will be carrying out further unannounced inspections at this service to assess whether the required improvements have been made. Where improvements are not made we have a range of enforcement powers that can be used, including prosecution, closure or restriction of services. “
Any regulatory decision that CQC takes is open to challenge by a registered person through a variety of internal and external appeal processes.
